1. What information do we collect?
We may collect, store and use the following kinds of personal information:

(e) collect fees and distribute repayments to Lenders.

(h) send you our newsletter and other marketing communications relating to our business which we think may be of interest to you, by post or, where you have specifically agreed to this, by email or similar technology. You may inform us at any time if you no longer require marketing communications.
(i) provide third parties with statistical information about our users – but this information will not be used to identify any individual user.
(j) deal with enquiries and complaints made by or about you relating to the website.
(k) keep the website secure and prevent fraud or other criminal activity.
(l) verify compliance with the terms and conditions governing the use of the website including monitoring Questions and Answers sent through our website Q & A facility.
(m) collect information about Borrowers to enable our third party specialist credit agency to assess the application before approval is granted to take out a loan. This allows us to identify you, prevent fraud and other criminal activities.
(n) collect information about Lenders to allow us to positively identify you for the purposes of preventing both fraud and money-laundering.
Your privacy settings can be used to limit the publication of your information on the website.
We will not, without your express consent, provide your personal information to any third parties for the purpose of direct marketing.
We will share information with our banking service provider, only to the extent necessary for the purposes of processing payments you make or receive via our website, refunding such payments and dealing with complaints and queries relating to such payments and refunds.
In addition, we may disclose your personal information:
(a) to the extent that we are required to do so by law;
(b) in connection with any ongoing or prospective legal proceedings;
(c) in order to establish, exercise or defend our legal rights (including providing information to others for the purposes of fraud prevention and reducing credit risk);
(d) to any person who we reasonably believe may apply to a court or other competent authority for disclosure of that personal information where, in our reasonable opinion, such court or authority would be reasonably likely to order disclosure of that personal information.

We will take reasonable technical and organisational precautions to prevent the loss, misuse or alteration of your personal information.
We will store all the personal information you provide on our secure (password- and firewall-protected) servers.
All electronic transactions entered into via the website will be protected by encryption technology.
You acknowledge that the transmission of information over the internet is inherently insecure, and we cannot guarantee the security of data sent over the internet.
You are responsible for keeping your password and other login details confidential. We will not ask you for your password (except when you log in to the website).

The Act regulates the use of personal data – essentially any information about identifiable living individuals. As a data controller under the Act, we must comply with its requirements.
Invest & Fund apply the Act's eight principles when obtaining, holding, using or disclosing information;

* obtained only for one or more specified and lawful purposes, and shall not be further processed in any manner incompatible with that purpose or those purposes;

* accurate and, where necessary, kept up to date;
* kept no longer than is necessary for the specified purpose(s);
* processed in accordance with the rights of data subjects under the Act;
* subject to appropriate technical and organisational measures to prevent the unauthorised or unlawful processing of personal data, or the accidental loss, destruction, or damage to personal data;
* not transferred to a country or territory outside the European Economic Area unless that country or territory ensures an adequate level of protection for the rights and freedoms of data subjects in relation to the processing of personal data.
The Act gives individuals the right to access personal information held about them by Invest & Fund by using a Subject Access Request. We will endeavour to provide that information to you within 28 days of a written request being made to Invest & Fund. A fee may be payable to service a Subject Access Request, about which we would inform you as part of the process.
Additionally, we adhere to the Privacy and Electronic Communications Regulations (PECR) in respect of all our unsolicited electronic communications; marketing calls, texts, emails and faxes. We offer an opt-in box to ensure we have your consent prior to contacting you.

2. About cookies
